Terms of Service

1. Introduction and acceptance

These Terms of Service ("Terms") are a binding agreement between you and tovtap. tovtap is operated as a sole proprietorship and registered DBA ("tovtap", "we", "us", or "our"), with a mailing address at 88 E San Carlos St, Unit 612, San Jose, CA 95112, United States, and a contact email of hello@tovtap.com. These Terms govern your access to and use of our website, our NFC tap cards and stands, our Insights analytics dashboard, our feedback inbox, our branded review pages, and every other product and service we offer (together, the "Services").

By visiting our website, creating an account, placing an order, using a card, or otherwise using any part of the Services, you agree to these Terms and to our Privacy Policy, which is incorporated by reference. If you do not agree, please do not use the Services. If you are using tovtap on behalf of a business, you confirm that you are authorized to bind that business, and "you" refers to both you and that business. You also confirm that you are at least 18 years old and able to enter into a binding contract.

2. Definitions

To keep these Terms clear, we use a few defined words:

  • "Card" or "cards" means the physical NFC tap cards, stands, card holders, and bundles we sell, including any embedded NFC chip and the short link it carries.
  • "Service" or "Services" means everything described in Section 1, including the website, hardware, review pages, feedback inbox, Insights analytics, and related software.
  • "Insights" means our optional paid analytics dashboard that shows tap and review activity for your account.
  • "Account" means the account you create to manage your cards, Insights, and feedback inbox.
  • "You", "your", or "customer" means the person or business that uses the Services or purchases products from us.
  • "Review page" means the branded page that opens when a card is tapped, from which a person can choose to leave a public Google review or share private feedback with your business.

3. The products and the service

tovtap sells physical NFC "tap to review" cards, stands, and card holders designed to help local businesses collect Google reviews and private feedback. When a customer taps a card with a phone, the card's chip carries a fixed short link in the form tovtap.com/r/<code>. We resolve the destination of that link on our servers, which means a card can be re-pointed to a new destination or disabled remotely without reprinting or replacing the hardware. This is what lets us keep your cards working over time.

Alongside the hardware, the Services include a branded review page, a feedback inbox where private feedback is delivered to you, and the Insights analytics dashboard. Reviews themselves are hosted by Google, a third party we do not control, as described in Section 14. The public reviews live on your Google Business Profile, not on tovtap.

4. Accounts

To manage your cards, view Insights, and read feedback, you create an account. We use passwordless sign-in: you can sign in with a magic link sent to your email, or with Google sign-in. Because there is no password to steal, keeping access to your email inbox and your Google account secure is an important part of keeping your account secure. You are responsible for all activity that happens under your account.

One account can hold many cards, so a business with several locations or many stands can manage everything in one place. You agree to provide accurate account information, including a valid email address, your name, your business name, and the Google review URL you want your cards to point to, and to keep that information current. Please notify us promptly at hello@tovtap.com if you believe your account has been accessed without your permission.

5. Orders, prices, and payment

All prices are shown in United States dollars (USD) on our website. Current product prices are: White or Black NFC Card at $24.99, Card 3-Pack at $59.99, Tap Stand at $34.99, and the Tap Pack bundle at $49.99. We work to display products and prices accurately, but we do not guarantee that descriptions, images, availability, or prices are always error-free or current, and we may correct errors, change prices, or update product details at any time before you place an order.

Payments are processed by our payment provider, Stripe. By providing payment details, you authorize us and Stripe to charge the total shown at checkout, including any applicable taxes, which are your responsibility. tovtap never sees or stores your full card number; Stripe handles your card data directly under its own security standards. Your order is an offer to buy, and no contract is formed until we accept it by confirming or shipping your order. We may limit quantities, refuse or cancel an order, or discontinue a product at any time. If we cancel an order you have already paid for, we will refund you.

6. Subscription terms (Insights)

Insights, our analytics dashboard, is free for the first 30 days. The 30-day free Insights trial runs from the first card activation on your account, and activating additional cards does not restart or extend it. After that free period, continued access to Insights costs $14.99 per month or $149 per year, billed per account, and covers all cards on your account. Your subscription is billed in advance through Stripe and renews automatically at the end of each billing period until you cancel.

You can cancel Insights at any time from your account or by emailing hello@tovtap.com. Cancellation takes effect at the end of your current billing period, so you keep access to Insights through the period you have already paid for. We do not provide refunds for partial billing periods. If we change subscription pricing, we will give you advance notice by email before the change applies to your account, and the new price will take effect on your next renewal. Most importantly: your reviews and cards keep working free for as long as tovtap operates the redirect service, even if you never subscribe to Insights or let a subscription lapse. Only the analytics dashboard is a paid feature; the tap-to-review function is always free. If we ever discontinue the redirect service, we will give you at least 60 days' notice by email and provide instructions so your cards can be re-pointed, so you are never left stranded.

7. Shipping

We ship physical products according to our Shipping Policy, which describes processing times, destinations, rates, and delivery estimates. In general, US shipping is free, orders are processed in 1 to 2 business days, and US delivery takes about 3 to 5 business days. We also ship to Canada and to limited international destinations, with rates shown at checkout. Please review the Shipping Policy for full details.

8. Returns and 30-day money-back guarantee

Every order is backed by our 30-day money-back satisfaction guarantee. If you are not satisfied for any reason, you can request a full refund within 30 days of receiving your order, as described on our Refund and Returns page. Please review that page for how to request a refund, replacement, or exchange.

9. Limited hardware warranty

We warrant that tovtap cards will be free from manufacturing defects in materials and workmanship for 30 days from the date of delivery. If a card fails because of a manufacturing defect within that period, your remedy is a free replacement card or a full refund, at your option. If you choose a replacement, we ship it to you at no cost after we confirm the defect. We may ask for a photo or a short description to help us confirm the issue and improve our products.

This warranty does not cover, and we are not responsible for, any of the following: physical damage such as bending, cracking, cutting, or crushing; damage from water, heat, sunlight, chemicals, or other abuse; normal wear and tear from everyday use; damage or failure caused by tampering, reprogramming, or attempting to modify the card or its NFC chip; and issues arising from write-locking the chip or from using the card in a way it was not intended. After the 30-day warranty period, cards are provided on an "as-is" basis with no warranty of any kind. This limited warranty is in addition to, and does not limit, your rights under our 30-day money-back satisfaction guarantee.

10. Disclaimer of warranties

Except for the limited hardware warranty in Section 9, the Services and all products are provided on an "as is" and "as available" basis, without warranties of any kind. To the fullest extent permitted by law, we disclaim all implied warranties, including the implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Services will be uninterrupted, timely, secure, or error-free, that any card or link will always resolve, or that using tovtap will produce any specific number of reviews, ratings, or business outcomes. Results depend on many factors outside our control, including your customers, your business, and Google. Some jurisdictions do not allow the exclusion of certain warranties, so some of these exclusions may not apply to you.

11. Limitation of liability

To the fullest extent permitted by law, tovtap and its owner, employees, and service providers will not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages, including lost reviews, lost revenue, lost customers, lost profits, lost or corrupted data, or business interruption, arising out of or relating to your use of the Services, even if we have been advised of the possibility of such damages. To the fullest extent permitted by law, our total aggregate liability for all claims relating to the Services is limited to the greater of the amount you actually paid us in the prior 12 months or US$100. Some jurisdictions do not allow certain limitations of liability, so parts of this section may not apply to you, in which case our liability is limited to the maximum extent permitted by law. Nothing in these Terms limits liability that cannot be limited under applicable law, including under California Civil Code section 1668 for fraud or willful injury.

12. Acceptable use

You agree to use the Services only for lawful purposes and in compliance with these Terms, applicable law, and Google's policies. You may not tamper with, reverse engineer, decompile, or reprogram the NFC chips or software in the cards; relabel, rebrand, or resell the cards as your own product without our written permission; point a card to any unlawful, deceptive, or harmful destination; or use the Services to attempt to manipulate, buy, incentivize, or fake reviews in violation of Google's policies or applicable law.

tovtap does not gate reviews, and neither should you. Every person who taps a card can freely choose to leave a public Google review or private feedback, with no step that filters people by how happy they are. Review gating, and steering only satisfied customers to public reviews, is prohibited. This approach is designed to comply with Google's policies and FTC guidance, and you are responsible for keeping your own use compliant, including maintaining an accurate Google Business Profile and following all applicable laws.

13. Our reserved rights

We may modify, suspend, or discontinue the Services, or any card or feature, at any time, with or without notice. Because card destinations are resolved on our servers, we may disable a card, re-point it, or suspend an account if we reasonably believe there has been abuse, illegal or deceptive use, review manipulation, fraud, a chargeback, or non-payment, or if doing so is needed to protect the Services, other users, or third parties. In the case of a payment dispute or chargeback, we will disable the cards associated with the disputed order, pending resolution, rather than all of your cards. We may also update these Terms as described in Section 18. These rights are in addition to any other rights and remedies available to us.

14. Third-party services and Google independence

Reviews live on Google, which is a third party we do not own or control. We are not responsible if Google changes its systems or policies, removes or hides reviews, changes review URLs, or is slow or unavailable. tovtap is an independent product and is not affiliated with, endorsed by, or sponsored by Google. Google and the Google logo are trademarks of Google LLC, and we reference Google only to describe how our product works with the Google review process.

We also rely on other third-party providers to operate the Services, including Stripe (payments), Supabase (data storage), Resend (email), Vercel (hosting), Cloudflare (DNS and email routing), and shipping carriers. Your use of features that depend on these providers may be subject to their own terms, and we are not responsible for the availability, policies, or actions of any third party.

15. Intellectual property

tovtap owns or licenses all rights in the platform, software, website, designs, review pages, Insights dashboard, and brand, including trademarks, logos, and product designs. Subject to these Terms, we grant you a limited, non-exclusive, non-transferable license to use the Services and the cards you purchase to collect reviews and feedback for your own business. You keep ownership of your own business content, such as your business name, your Google review URL, and the feedback your customers send you. You may not copy, modify, distribute, or use our intellectual property except as needed to use the products and Services you purchased.

16. Indemnification

You agree to indemnify, defend, and hold harmless tovtap and its owner, employees, and service providers from and against any claims, damages, losses, liabilities, and expenses, including reasonable legal fees, arising out of or related to your misuse of the Services, your violation of these Terms, or your violation of any law or the rights of any third party, including Google's policies.

17. Privacy

Our Privacy Policy explains what information we collect, how we use it, and how we protect it, including what tap data we collect when a card is tapped. By using the Services, you agree to our Privacy Policy, which forms part of these Terms. Please review it carefully.

18. Changes to these Terms and termination

We may update these Terms from time to time. When we do, we will update the "Last updated" date at the top of this page, and significant changes will be communicated by email or a notice on the site. Your continued use of the Services after an update means you accept the revised Terms. You may stop using the Services at any time. We may suspend or terminate your access to the Services, or to Insights, as described in Section 13. Sections that by their nature should survive termination, including disclaimers, limitation of liability, indemnification, and governing law, will continue to apply.

19. Governing law and dispute resolution

These Terms are governed by the laws of the State of California, USA, without regard to its conflict of laws rules. If a dispute arises, you agree to first contact us at hello@tovtap.com so we can try to resolve it informally, which is usually the fastest way to a fair outcome. If we cannot resolve the issue informally, any dispute relating to these Terms or the Services will be resolved in the state and federal courts, including small claims court where appropriate, located in Santa Clara County, California, and you consent to their jurisdiction and venue.

20. General

A few general terms round out this agreement. Severability: if any part of these Terms is found to be unenforceable, the rest stays in full effect, and the unenforceable part is limited or removed to the smallest extent needed. Entire agreement: these Terms, together with our Privacy Policy and the policy pages referenced here, are the entire agreement between you and tovtap about the Services and replace any prior understandings. If these Terms conflict with a policy page (Shipping, Returns, Privacy), these Terms control.

Assignment: tovtap may assign or transfer these Terms, including in connection with a merger, acquisition, or sale of the business, and your rights under them will carry over. You may not assign these Terms without our written consent. No waiver: if we do not enforce a part of these Terms right away, that is not a waiver of our right to do so later. Force majeure: we are not responsible for delays or failures caused by events beyond our reasonable control, such as natural disasters, outages, carrier delays, or actions of third parties like Google. Consent to electronic communications and notices: you consent to receive communications and notices from us electronically, including by email and through the site, and you agree that electronic notices satisfy any legal requirement that a notice be in writing, consistent with the federal E-SIGN Act.
